A Roundtable on Reforms of the Labour Code of the Kyrgyz Republic

LEX Law Firm participated in a roundtable discussion on the reform of the Labour Code of the Kyrgyz Republic on November 9, 2022. Representatives of the International Business Council (“IBC”) and the International Labour Organization (“ILO”), including the ILO Moscow Office, discussed problematic issues of the current Labour Code of the Kyrgyz Republic.

Participants considered amendments to the Labour Code of the Kyrgyz Republic aimed at improving cooperation between employers and employees as well as creating conditions for effective interaction with investors.

Among the participants of the round table were Kudaibergen Bazarbaev, the Minister of Labour, Social Security and Migration of the Kyrgyz Republic, Talaibek Koichumanov, Head of the Secretariat of the Investment Council under the Cabinet of Ministers of the Kyrgyz Republic, Askar Sydykov, Executive Director of IBC, Zhodar Omoshev, Chairman of the Board of JIA Business Association, Emil Kyzaev, Chairman of the Federation of Trade Unions of the Kyrgyz Republic and Olga Kulaeva, ILO Bureau Director for Eastern Europe and Central Asia.

The agenda highlighted the main points in the Labour Code of the Kyrgyz Republic that require amendments and improvements. These include the introduction of the concept of telecommuting, the establishment of limitation periods for the recovery of wages, the modern administration of work records using modern information technology and others.

As well it is worth noting that it was suggested earlier to work on the Labour Code of the Kyrgyz Republic in terms of balancing the interests of employers and employees, and it was also suggested that best international practice should be used.

The purpose of the round table was to amend the Labour Code of the Kyrgyz Republic to improve the investment climate in the country, develop effective mechanisms for all stakeholders - the trade union movement, the business community and the Ministry of Labour, Social Security and Migration of the Kyrgyz Republic - to work in line with current trends.
