LEX Law Firm successfully defended its client's interests in court in a criminal case related to charges under Part 1 of Article 138 of the Criminal Code of the Kyrgyz Republic – “Causing grievous bodily harm.” The prosecution sought a prison sentence of seven years, but our lawyers secured a complete dismissal of the case.

How did we achieve this?

1. Analysis of evidence and identification of violations.

After a detailed review of the criminal case materials, our experts began to question the accuracy of the forensic medical examination (FME). It was found that the expert opinion contradicted the Rules for Forensic Medical Assessment of the Severity of Harm to Health (approved by Decree of the Government of the Kyrgyz Republic No. 33 of January 12, 2012).

2. Conducting a re-examination.

The court granted our motion, and the new examination revealed less severe harm to health, which allowed the charge to be reclassified under a less severe provision.

We didn’t stop there! After negotiating with the victim, our attorneys secured a settlement between the parties. This led to the criminal case being completely dismissed, and our client was released right in the courtroom.
