Central Asian Cyberlaw Forum: Legal Boundaries in the Public, Private and Digital Spheres

On December 5-6, 2024, LEX Law Firm participated in the Central Asian Cyberlaw Forum Digital Law Forum - 2024. The main theme of the forum focused on legal boundaries in the public, private and digital spheres.

The Forum brought together leading lawyers, judges, IT product developers, representatives of business, academic community, law enforcement and government agencies from the Kyrgyz Republic, Kazakhstan, Uzbekistan, and the Russian Federation. International speakers included experts from Turkey, France, Canada, the Netherlands and other countries.

During the forum, experts noted that the national legislations of Central Asian countries do not meet modern trends and do not keep up with technological progress. They also emphasized the importance of respecting the boundaries of legal regulation of technology and innovation. Excessive legal regulation can lead to a decline in technology development and its outflow to other developed countries. Experts suggested that the state should develop some rules of the game and minimize interference in the process itself, stressing that it is important to find a balance between innovation, security and rights in the digital environment.

The discussion focused on the feasibility of codifying normative legal acts in the digital sphere. The experts agreed that while the issue of codification was not relevant before, in the digital era, when new technologies are emerging every day, the time has come to adopt a unified digital code. Due to the dynamic development of technologies, it is important that the code to be flexible, contain fundamental principles and lay the foundation for the adoption of acts defining the rules for regulating relations in the digital environment.

Representatives of law enforcement agencies shared their experience in investigating cybercrime. In their opinion, difficulties arise due to the lack of legislative framework and digital evidence collection skills of law enforcement officers.

The forum discussed legal regulation of artificial intelligence, digital assets, cybercrime and digital resilience.

During the discussion, the participants voiced their recommendations for improving legislation and developing cooperation to adapt rights in the wake of technology.
